KYSSA spark. In real life.

Terms and Conditions

Beta version · applies when you agree

The terms for using the KYSS beta, operated by David Stein.

About KYSS and these terms

KYSS is a nearby connection service for dating and friendship, operated by David Stein. Contact david@steindavid.com for service, privacy or safety questions. These beta terms apply when you tick the agreement box and successfully sign in or create an account. You must make that choice for each new sign-in. Reading a policy, requesting a code or installing an update does not by itself record an accepted sign-in.

A beta can change and may have interruptions. Feature availability and account restrictions are shown in the app. We do not promise a particular number of nearby people, a connection, continuous availability or an exact physical location.

Eligibility and account security

You must be at least 18 and provide truthful eligibility information. Use your own account and a recognition photograph you are entitled to use. Keep your email account and confirmation codes secure. Contact support if another person may have accessed your account.

Do not impersonate someone, provide a false birthday to gain access, share a sign-in code, bypass a restriction or open another account to evade a block. A profile, birthday or photo result is not independent identity or adult verification.

Your choices and your conduct

Enter Orbit only when you want to be discoverable. A private Signal, mutual or Continue decision does not permit unwanted contact, following, touching, photography or sexual activity. Respect refusals and withdrawals without demanding an explanation.

Your Community Rules obligations also apply to messages, clues, photos and in-person conduct connected with KYSS. You must not threaten, exploit, harass, deceive or expose private information. Do not scrape the service, track nearby identifiers, attack its systems or use it for unsolicited commercial promotion.

Your content and our use of it

You retain your rights in the content you provide. You give KYSS the permission necessary to store, prepare, transmit and display it for the functions you choose, maintain the service, and handle safety concerns. This permission is limited by the privacy information, your disclosure choices and any lawful retention need.

Only share material you have the right to use. Other people’s messages and disclosed information do not become yours to publish or exploit. Taking a screenshot or saving information can create copies KYSS cannot recall.

Restrictions, review and account closure

We can limit features, remove content or restrict an account where needed to address a safety concern, rule breach, legal requirement or security threat. Where a review route is available, the app explains how to request it. You can also contact support about an account decision. A review does not promise reinstatement or disclosure of another person’s private information.

You may stop using KYSS and request account deletion using the account controls. A subscription is cancelled separately through Apple. Paid access does not override blocks, consent, age requirements or a safety restriction.

Purchases, legal rights and changes

When available, Plus is purchased through Apple under the price and renewal period shown before confirmation. Read Subscription Terms before buying. These terms do not exclude or reduce rights and remedies that cannot lawfully be excluded, including applicable Australian Consumer Law rights.

Contact David Stein about a service problem or complaint. Apple also provides purchase-management and refund-request routes. Material changes to these documents require an updated version and appropriate notice or a new agreement. Agreeing to these terms and acknowledging the Privacy Policy does not grant permission for undisclosed new uses of your information or sign you up to marketing.
